Definitions

Customer - a natural person, a legal person or an organizational unit that is not a legal person, to which special regulations grant legal capacity, who makes or intends to make an Order within the store and who has accepted these Regulations;

Online store - Internet service available at homekomfort.pl, through which the Customer may purchase Products;

Product - goods presented in the Store to which the contract of sale applies;

Regulations - these Regulations for sales by means of distance communication
and provision of services by electronic means;

Order - the Customer's statement of intent, aiming directly at the conclusion of the Contract of sale of Products at a distance through the Store, specifying the type and number of Products;

Transaction - the purchase of selected Products from the Store by the Customer in accordance
with the provisions of these Regulations, based on an order placed.

Payment - the Client's monetary consideration made for a Transaction.

Sales Contract - a contract for the sale of Products within the meaning of the Civil Code, concluded between the Store and the Customer, using means of distance communication.

General provisions

  1. These Regulations are the regulations referred to in Art. 8 of the Act on Providing Services by Electronic Means of July 18, 2002. (Journal of Laws of 2002, No. 144, item 1204, as amended).
  2. Ekosolar Sp. z o.o., operating under the address homekomfort.pl is run by the company: Ekosolar Sp. z o.o., ul. Energetyków 38, 44-335 Jastrzębie-Zdrój, NIP: 6332239697, REGON: 382756064, District Court in Gliwice, X Economic Division of the National Court Register under KRS number: 000077522
  3. The purpose of running a store is:
    • enabling Customers to place Orders for Products available within the homekomfort.pl online store
    • concluding Distance Sales Agreements for Products
    • Providing customers with information about the Products available in the Store.
  4. The use of materials placed on the site (photos, texts, graphic materials) owned by Ekosolar Sp. z o.o. or manufacturers of the brands offered, without the consent of the site owner is prohibited.
  5. The prices of the Products on offer at the Store are given in Polish Zloty, Euro, Czech koruna and include VAT.
  6. The regulations are translated into English, Slovak, Czech and Ukrainian for information purposes. The leading regulations are in Polish.

Rules of use of the store and conclusion of the sales contract

  1. The sales contract is concluded between the Customer and Ekosolar Sp. z o.o.
  2. In order to start using the Store, it is necessary to read and accept the Terms and Conditions.
  3. To conclude a sales contract, you must place an Order through the Online Store.
  4. Orders placed in the Online Store are accepted from Monday to Sunday and processed on the next business day after the order is placed.
  5. The condition for placing an Order is to fill in the required data necessary for shipping or VAT invoice in the form.
  6. To place an Order, select a model, color and size from the list of products by adding the Product to the shopping cart.
  7. Submission of an Order by the Customer constitutes an offer made by the Customer to Ekosolar Sp. z o.o. as to the conclusion of a Sales Contract, in accordance with the content of the Regulations.
  8. After the Customer places an Order, he/she will receive a message via email containing information regarding the quantity of products, the value of the order, the selected type of delivery and payment, the order processing time and the shipping details. The message constitutes confirmation that the Store has received the Customer’s purchase offer.
  9. The Customer receives a confirmation of acceptance of the Order to the indicated e-mail address, upon receipt of the aforementioned. After receiving the above confirmation, the Sales Agreement of the Products ordered by the Customer is concluded.

Delivery

  1. The lead time given in the order summary is 1-7 business days.
    In exceptional situations, the lead time is confirmed individually with the customer.
  2. Products are delivered within the territory of the Republic of Poland through cooperating courier companies. The expected delivery time is 1 working day from the day following the shipment. The total and maximum delivery time of the Order should not exceed 7 working days. The start of processing of the Order may be delayed until the amount of the sales price is credited to the Store's bank account.
  3. Each shipped item is accompanied by a proof of purchase.
  4. When receiving a shipment delivered by a courier, the Customer, should check the condition of the external packaging of the shipment. In case of damage to the package of the consignment, the Customer should draw up a damage report with the supplier of the consignment, in two identical copies signed by the Customer and the courier.

Payment Methods

  1. The customer pays for the ordered products:
    a) in cash at the place of delivery (cash on delivery),
    b) by bank transfer before delivery. c) via payment operators such as PayU
  2. If you choose the payment method by bank transfer, the store waits for payment for 7 days, after which the order will be canceled. The processing of the order begins after receipt of payment for the goods.
